Data protection policy

1. Preamble

In its capacity as data controller in respect of the amended Information and Liberty law of 06 January 1978, MAJJ Avocats is liable to collect personal data communicated by you.

MAJJ Avocats places the utmost importance in the respect of your privacy and the protection of your personal data and takes all necessary measures to ensure the confidentiality and security of your personal data.

This data protection policy presents exactly how MAJJ Avocats collects, uses and communicates the personal data entrusted to it by you, through the use of this site or when requesting services. To this end, MAJJ Avocats invites you to take note of this policy in order to be informed of the terms for the processing of your personal data and of your rights. This policy may be modified, revised or supplemented, in particular in order to ensure compliance with regulatory changes.

MAJJ Avocats ensures that only strictly necessary data is collected and processed in view of the processing purpose (minimisation of data). Simple consultation of this site does not involve the transmission of personal data.

Most of the data processing carried out by MAJJ Avocats falls within the scope of necessary processing for the establishment of the pre-contractual relationship and/or contractual and the provision of the requested services, i.e. the provision of legal services or training services by a member of MAJJ Avocats to the benefit of a natural person or legal entity.

MAJJ Avocats may collect your personal data for the following reasons:

  • Processing of requests sent via the website;
  • Provision of services (advice, representation before administrative or legal authorities, legal assistance, legal training, etc.);
  • Management of your registration at training and/or events organised by the firm;
  • Establishment of the pre-contractual and/or contractual relationship;
  • Management of private or professional prospects;
  • Management and monitoring of applications;
  • Necessity to comply with legal or regulatory obligations;
  • Billing, accounts and payment, in particular sending invoices by email, debt collection, fee agreements, management of unpaid invoices and litigation.

4. Nature of collected data

As data collector, MAJJ Avocats is liable to collect the following personal data concerning you:

  • First name, last name and title;
  • Personal contact information;
  • Professional contact information;
  • Name of your employer, your company, its group;
  • References, tax and banking data;
  • Social security number.

5. Data destination

As far as strictly necessary for the performance of the mission entrusted to it and the management of your request, and in accordance with the rules related to professional secrecy, your personal data is only accessible to (i) the members of MAJJ Avocats; (ii) third parties with whom we work and interact (chartered accountants, banks, judicial persons, administrative authorities, particularly social and tax, legal colleagues, the professional order, bailiffs, courts, training finance organisations…).

6. Use of subcontractors

Wishing to provide you with the best service and to accomplish the above described purpose, MAJJ Avocats may communicate your personal data to the following recipients in accordance with the applicable data protection regulations:

  • subcontractors, service providers, professional advisers: MAJJ Avocats is liable to employ or call upon other companies to carry out certain functions in its name. They are subject to contractual and legal obligations to protect your privacy and the confidentiality of your data. In particular, these are our IT service providers, along with accounting and billing service providers. These companies are established in Europe;
  • in order to meet legal and regulatory requirements, MAJJ Avocats may share your personal data with public organisations, judicial or administrative authorities and regulatory bodies.

7. Data conservation

MAJJ Avocats only keeps your data as long as is necessary for the operations for which it was collected and in compliance with applicable legislation.

In this respect, your data as a client is kept for the duration of the contractual relationship plus 3 years, for promotional and prospection purposes, without prejudice to conservation obligations or statutes of limitation.

For accounting purposes, it is kept for 10 years from the end of the accounting year.

In respect of the prevention of money-laundering and the financing of terrorism, data is kept for 5 years after the end of the relationship with MAJJ Avocats.

Prospect data is kept for 3 years after the most recent contact with MAJJ Avocats.

Candidates’ data is kept for 2 years after the most recent contact, unless the candidate asks for it to be destroyed.

8. Security

MAJJ Avocats ensures the security of your personal data by putting in place reinforced data protection via the use of physical and digital security systems.

9. Your rights

Pursuant to the Information and Liberty regulations, in respect of all the data belonging to you, you have a right of access, rectification, deletion, limitation of processing, opposition, portability as the case may be and to define what becomes of your personal data after your death.

This right may be exercised:

We may ask you to identify yourself in order to process your request.

MEdiation – Disputes

Any challenge in relation to the amount and collection of fees, expenses and disbursements by MAJJ Avocats may only be settled, in the event of failure by the parties to reach an agreement, by recourse to the procedure provided for in articles 174 and following of decree n°91-1197 of 27 November 1991 which organises the legal profession.

The most diligent party shall apply to the Chairman of the Paris Bar at the Court of Appeal.

In accordance with the provisions of articles L.612-1 et seq. of the French Consumer code, it is possible to apply free of charge to the Consumer Mediator of the National Bar Association, with contact details as follows:
